Upload at your own risk: Most cloud storage services offer no data guarantee (Digital Trends)

It?s become increasingly clear that users who lost files due to the US government?s seizure of Megaupload will, most likely, never get their files back. First of all, Megaupload?s hosting company, Carpathia Hosting, will allegedly begin deleting files on Thursday due to non-payment by Megaupload. Second ? and here?s the stickler ? Megaupload never guaranteed that files stored on its servers would remain accessible to users in the first place.

?To the extent there are users that do have copies stored on Megaupload.com, it is important to note that Mega clearly warned users not to keep a sole copy of material on the site,? a Department of Justice spokesperson told Digital Trends last week, via email. ?In fact,? Megaupload.com expressly informed users through its Frequently Asked Questions (?FAQs?) and its Terms of Service that users have no proprietary interest in any of the files on Megaupload?s servers, they assume the full risk of complete loss or unavailability of their data, and that Megaupload can terminate site operations without prior notice.?

Of course, Mega was primarily used for sharing files, not storing them long-term. (Though it?s obvious now that many people used it for the latter purpose.) Still, this got us thinking: Do any cloud storage services guarantee your files will be safe and sound? We took a look at the Terms of Service of a number of popular cloud storage and file-sharing companies. And what we found was, well, not good. Take a look:

Dropbox

You, and not Dropbox, are responsible for maintaining and protecting all of your stuff. Dropbox will not be liable for any loss or corruption of your stuff, or for any costs or expenses associated with backing up or restoring any of your stuff.

Box

Box is in no way liable for loss of customer data. Under no circumstances will Box be held accountable for any loss of customer data. By becoming a Box user you, the customer, acknowledge that you forfeit the right to hold Box accountable for any and all technical errors, including loss of user files (customer data).

Rapidshare

The user is responsible for the backing up (to his own computer or other devices) of the files that he stores or accesses on RapidShare?s servers. RapidShare does not guarantee or warrant that any content that the user saves, stores or accesses through the service will not be subject to inadvertent damage, corruption or loss.

Google Docs

You get the point: If you fail to back-up your data, it?s your fault if it?s lost forever, full stop. These companies protect themselves from lawsuits by removing all responsibility to keep user files accessible. Therefore, storing your files exclusively on a cloud service is a terrible idea.

Out of the cloud storage companies we investigated (and by no means did we look at all of them), there were a few exceptions. The first is Carbonite. While its Terms of Service were significantly more jumbled with legalese than the rest (save Google), their policy appears slightly better for the end user than the rest. And by that, we mean that Carbonite may, in some instances, refund you the $60 it charges for a year?s subscription to its service. But not necessarily.

The second is Nasuni, which is the only company we found that offers a 100 percent guarantee on 24/7 uptime, and 100 percent access to your data. Unfortunately, Nasuni is exclusively geared toward businesses, so it?s not really a viable option for most casual cloud-storage users.

In the end, storing your files in a single location ? be that on your home computer, an external drive, or a cloud storage service ? it?s not wise computing. We recommend keeping important files in a minimum of three locations; all of the above would be a good place to start. Too bad someone didn?t tell Megaupload users that before they lost their files.

Wilfork keen on helping himself to more work as Super Bowl (Reuters)

INDIANAPOLIS (Reuters) ? Defensive tackle Vince Wilfork already has a Super Bowl ring to his name but Sunday he goes into the NFL's championship game as the leader of a New England Patriots defense and wanting to play every down.

Wilfork was a rookie on the Patriots' team who won the Super Bowl at the end of the 2004 season with victory over the Philadelphia Eagles; a relatively minor figure in a defense filled with quality veterans.

But his increased importance to the team can be measured in the amount of time he spends on the field.

His involvement in plays has gradually grown and by the AFC title game against the Baltimore Ravens, Wilfork played an impressive 67 of 70 snaps and the 30-year-old showed his stamina to come up with two crucial plays late in the game.

"I think conditioning is everything, being able to go," Wilfork told reporters Monday after practice.

"The more stress you can put on yourself in the off-season and training camp, I think it allows you to play at a high level once you get later in the season.

"That's one (thing) I did a real good job of, putting that stress on myself this off-season.

Wilfork is heavily-built, weighing 147 kilograms (325 pounds), with a large girth on a 1.88-metres (six-foot-two) frame, but his coach Bill Belichick said that disguises a strong athlete.

"He doesn't have the classic appearance but he is a good athlete, he is in good shape and he can play a lot of plays and play them well," Belichick said.

The tackle's increased involvement in games was initially born of necessity but has become something the player sees as a sign of his commitment.

"He has the ability to play on all three downs," said Belichick.

"Last year we had some injuries and Id say he was forced into it a little bit because of our lack of depth on the defensive line.

"This year, he takes a lot of pride about not coming off the field, which I love in a defensive lineman.

"That's the way Vince's attitude is. He is in good condition. Out at practice today (Monday) during the offensive period, he's running sprints back and forth across the field.

"There is a week to go in the season and I think that is indicative of his competitiveness, his desire to be consistently good, week after week."

Wilfork said that while he has had to work on his fitness, he is a competitor by nature.

"All of my life I've been competitive. I always want to be in the middle of everything," he said.

"All of my life I've thought that I'm a leader and I think leaders have to take control at some point and show the will to do whatever it takes to turn things around.

"At a young age, I had that fight and it is a good fight."

It is an approach that makes him an opponent the Giants are well aware they will have to be smart, as well as strong, to overcome.

"He is definitely hard to move," Giants' running back Brandon Jacobs said. "He is strong and he is quick for his size.

"He is not one dimensional. He makes it really hard for people to figure out how they are going to block him."

Kevin White, ex-Boston mayor, dies (Politico)

BOSTON - Former Mayor Kevin H. White, who led the city for 16 years including racially turbulent times in the 1970s and was credited with putting it on a path to prosperity, died Friday, a family spokesman said. He was 82.

White, who had been diagnosed with Alzheimer?s disease in 2003, died peacefully at his Boston home surrounded by his family, spokesman and friend George Regan said.

?He was a man who built Boston into the world-class city it is today,? said Regan, who called his loss ?devastating.?

White, a white Irish Catholic from a family of politicians, is credited with revitalizing Boston?s downtown and seeing the city through court-ordered busing, but he ended his four-term tenure in 1983 under a cloud of ethics suspicions.

White, a Democrat, was elected Massachusetts secretary of state three times before running for mayor for the first time in 1967 against antibusing activist Louise Day Hicks. He defeated her with support from the black community and liberals.

After losing a 1970 bid for governor, White was re-elected mayor in 1971, again defeating Hicks. He won again narrowly in 1975 and 1979.

White was considered as a vice presidential running mate to South Dakota U.S. Sen. George McGovern in 1972 but was passed over for Missouri U.S. Sen. Thomas Eagleton, who was later shunted aside for R. Sargent Shriver Jr.

After U.S. District Court Judge W. Arthur Garrity ordered busing to desegregate public schools in 1974, White protected schoolchildren from violence with federal and state assistance during the period of crisis and in 1976 led a march of 30,000 to protest racial violence.

White was never totally comfortable with busing, however, and called Garrity?s plan ?too severe.?

?I wish I knew a way to have taught Garrity or convinced Garrity to be more generous ? or softer in his implementation of that order,? White said after his time as mayor.

Massachusetts? U.S. Sen. John Kerry, a fellow Democrat, said White ?knew how to wisely wield the power of the mayor?s office for the public good.?

?For 16 years,? Kerry said in a statement, ?the mayor shepherded the city through the turbulence of the late ?60s and mid-?70s and in the process ushered in the remarkable city we know today.?

Current Mayor Thomas Menino, also a Democrat, praised White for his contributions to the city.

?Mayor Kevin White was a great friend and a great leader who left a lasting mark of hope and inspiration on the City of Boston,? he said in a statement. ?He will be sorely missed.?

IMF leads global push for euro zone to boost firewall (Reuters)

DAVOS, Switzerland (Reuters) ? International Monetary Fund chief Christine Lagarde led a global push on Saturday for the euro zone to boost its financial firewall, saying "if it is big enough it will not get used."

Lagarde, supported by the British finance minister, George Osborne, said the IMF could boost its support for the euro zone but pressed its leaders to act first. Some attendees at the Davos Forum still doubted the viability of the currency union.

Countries beyond the 17-country bloc want to see its members stump up more money before they commit additional resources to the IMF, which this month requested an additional 500 billion euros ($650 billion) in funding.

"Now is the time - there has been a lot of pressure building in order to see a solution come about," Lagarde told a Forum panel discussion on the economic outlook from which euro zone leaders - most notably Germany - were conspicuously absent.

"It is critical that the euro zone members develop a clear, simple firewall that can operate both to limit the contagion and to provide this sort of act of trust in the euro zone, so that the financing needs of that zone can actually be met," she said.

Lagarde's comments rounded out a crescendo of calls at the Davos Forum for the euro zone to boost its financial defenses. The annual five-day conference began with German Chancellor Angela Merkel deflecting pressure to do so.

In a carefully worded keynote address, Merkel suggested doubling or even tripling the size of the fund may convince markets for a time, but warned that if Germany made a promise that could not be kept, "then Europe is really vulnerable."

On Friday, U.S. Treasury Secretary Timothy Geithner pressed Europe to make a "bigger commitment" to boosting its firewall.

Two bankers who attended meetings with Geithner at the Forum said on Friday the United States was looking for the euro zone to roughly double the size of its firewall to 1.5 trillion euros. There was no immediate comment from the U.S. Treasury.

Osborne said the currency bloc must beef up its firewall before other countries increase their funding to the IMF.

"I think the euro zone leaders understand that," said Osborne, the only European minister on Saturday's panel discussion on the global economic outlook in 2012.

"There are not going to be further contributions from G20 countries, Britain included, unless we see the color of their money," he added, calling for the euro zone "to provide a significant increase in available resources."

MORE OPTIMISM...FOR SOME

Japanese Economics Minister Motohisa Furukawa echoed Osborne's comments, saying: "Without the firm action of Europe, I don't think the developing countries like China or others are willing to pay more money for the IMF."

On condition that the euro zone boosts its own defenses, he said Japan and other countries were willing to additional support via the IMF.

Lagarde said, however, that if the international lender's resources were boosted sufficiently, this would raise confidence to such a degree that they would not be needed.

"If it is big enough, it will not get used. And the same applies to the euro firewall for that matter," she added.

Japanese Prime Minister Yoshihiko Noda, speaking to the Forum by video link from Tokyo, said Japan was working with South Korea and India to reduce the risk of the euro zone crisis spreading to Asia.

"Japan stands ready to support the euro zone as much as possible," he added.

Mexico's central bank chief, Agustin Carstens, said on Friday he believed a consensus was building on boosting the IMF's resources to help European countries and others that might need aid from the global lender.

There has been a palpable sense of hope at the Davos Forum that the euro zone is pulling back from the brink of catastrophe, though business leaders are equally worried that Europe's woes will hold back a global recovery.

Osborne saw some signs of optimism.

"People have commented on the mood of this conference being quite somber but having been here for a couple of days people have also pointed out that actually people are slightly more optimistic at the end of the week than the beginning," he said.

However, Davos 2011 also ended on upbeat note about the euro zone and a feeling that worst of the crisis was over - only for the situation to deteriorate and financial markets to turn their fire on Italy, the bloc's third biggest economy.

"The euro zone is a slow-motion train wreck," said economist Nouriel Roubini, made famous by predictions of the 2008-09 global banking crisis.

He expected Greece, and possibly Portugal, to exit the bloc within the next 12 months and believed there is a 50 percent chance of the bloc breaking up completely in the next 3-5 years.

Hong Kong's Chief Executive, Donald Tsang, said no matter how strong the euro zone's firewall is, the market will look at the nature of the economies it is protecting.

"If it is protecting insolvent economies...no matter how strong the firewall is, it won't survive," he said.

Robert Hegyes, played Epstein on 'Kotter,' dies (AP)

METUCHEN, N.J. ? Robert Hegyes, the actor best known for playing Jewish Puerto Rican student Juan Epstein on the 1970s TV show "Welcome Back Kotter" has died. He was 60.

The Flynn & Son Funeral Home in Fords, N.J., said it was informed of Hegyes' death Thursday by the actor's family.

A spokesman at JFK Medical Center in Edison, N.J., told the Star-Ledger newspaper that Hegyes, of Metuchen, arrived at the hospital Thursday morning in full cardiac arrest and died.

Hegyes was appearing on Broadway in 1975 when he auditioned for "Kotter," a TV series about a teacher who returns to the inner-city New York school of his youth to teach a group of irreverent remedial students nicknamed the "Sweathogs." They included the character Vinnie Barbarino, played by John Travolta.

The show's theme song, performed by John Sebastian, became a pop hit.

Hegyes also appeared on many other TV series, including "Cagney & Lacey."

He was born in Perth Amboy and grew up in Metuchen, the eldest child of a Hungarian father and Italian mother.

He attended Rowan University, formerly Glassboro State College, in southern New Jersey, before heading to New York City after graduation. He returned to Rowan on several occasions to teach master classes in acting, a university spokesman said Thursday.

"He was a good friend to the university," spokesman Joe Cardona said.

Hegyes continued to act after "Kotter" and was a regular on "Cagney & Lacey." He also guest-starred in shows including "Diagnosis Murder" and "The Drew Carey Show."

On his website, Hegyes wrote that he was inspired by Chico Marx, whom he had played in a touring production of a show about the Marx Bros. He also recalled how his mother encouraged him to get involved in theater as a teen.

Underwhelmed by the ZTE tablet spotted yesterday? Perhaps the promise of a Honeycomb-decked seven-incher from Sprint will win your tablet hungry dollars. Advertising materials leaked over at Android Police, revealing that the previously unseen slab will arrive next month both on contract ($100) and off ($349). The 1.2GHz dual-core Optik wields a 5 megapixel camera on the back, paired with a front-facing 2 megapixel shooter, while there's a respectable chunk of storage (16GB), expandable by micro-SD. Although there may be more eye-opening propositions when it comes Android tabs, those on the hunt for one that won't claim a heavy chunk of your paycheck and still pack some respectable technical specs may have found an interesting new contender.

APNewsBreak: US to unveil new forest rules (AP)

WASHINGTON ? The Obama administration says new rules to manage nearly 200 million acres of national forests will protect watersheds and wildlife while promoting uses ranging from recreation to logging.

The new rules, to replace guidelines thrown out by a federal court in 2009, are set to be released Thursday by Agriculture Secretary Tom Vilsack. A summary was obtained by The Associated Press.

Vilsack said in an interview that the rules reflect more than 300,000 comments received since a draft plan was released last year. The new rules strengthen a requirement that decisions be based on the best available science and recognize that forests are used for a variety of purposes, Vilsack said.

"I think it's a solid rule and done in a collaborative, open and transparent way," he said.

The guidelines, known as a forest planning rule, will encourage forest restoration and watershed protection while creating opportunities for the timber industry and those who use the forest for recreation, he said.

Vilsack, who has pledged to break through the logjam of political conflict over forest management, said the new regulation's emphasis on science and multiple uses should allow it to stand up to likely court challenges from environmental groups or the timber industry.

"I am hopeful and confident that it will stand scrutiny," he said.

Forest Service Chief Tom Tidwell said the guidelines would allow land management plans for individual forests to be completed more quickly and at a lower cost than under current rules, which date to the Reagan administration.

Several attempts to revise the 1982 planning rule have been thrown out by federal courts in the past decade. Most recently a Bush administration plan was struck down in 2009. Environmentalists had fought the rule, saying it rolled back key forest protections.

The Obama administration did not appeal the ruling, electing to develop a new forest planning rule to protect water, climate and wildlife.

Under the new rule, forest plans could be developed within three to four years instead of taking up to seven years, as under current guidelines, Tidwell said.

"We really can protect the forest at lower cost with less time," he said.

The new regulation also should give forest managers more flexibility to address conditions on the ground, such as projects to thin the forest to reduce the risk of wildfire, Tidwell said.

"We'll be able to get more work done ? get more out of the forest and create more jobs," while at the same allowing greater recreational use, Tidwell said. Recreational use of the forest has grown exponentially in recent years.

Like Vilsack, Tidwell said he is optimistic the new plan will stand up to scrutiny from environmental groups and the timber industry, both of which have challenged previous planning rules in court.

"I'm optimistic that folks will want to give it a shot," Tidwell said.

The 155 national forests and grasslands managed by the Forest Service cover 193 million acres in 42 states and Puerto Rico. Balance between industry and conservation in those areas has been tough to find since the existing rules went into effect three decades ago.

At least three revisions of the rules have been struck down since 2000.

The planning rule designates certain animal species that must be protected to ensure ecosystems are healthy. However, the rule became the basis of numerous lawsuits that sharply cut back logging to protect habitat for fish and wildlife.

Meanwhile, the timber industry has continued to clamor for more logs, and conservation groups keep challenging timber sales, drilling and mining projects.

Patterns of chromosome abnormality: The key to cancer?

A healthy genome is characterized by 23 pairs of chromosomes, and even a small change in this structure ? such as an extra copy of a single chromosome ? can lead to severe physical impairment. So it's no surprise that when it comes to cancer, chromosomal structure is frequently a contributing factor, says Prof. Ron Shamir of the Blavatnik School of Computer Science at Tel Aviv University.

Now Prof. Shamir and his former doctoral students Michal Ozery-Flato and Chaim Linhart, along with fellow researchers Prof. Shai Izraeli and Dr. Luba Trakhtenbrot from the Sheba Medical Center, have combined techniques from computer science and statistics to discover that many chromosomal pairs are lost or gained together across various cancer types. Moreover, the researchers discovered a new commonality of chromosomal aberrations among embryonic cancer types, such as kidney, skeleton, and liver cancers.

These findings, recently published in Genome Biology, could reveal more about the nature of cancer. As cancer develops, the genome becomes increasingly mutated ? and identifying the pattern of mutation can help us to understand the nature and the progression of many different kinds of cancer, says Prof. Shamir.

Looking at the big picture

As cancer progresses, the structure of chromosomes is rearranged, individual chromosomes are duplicated or lost, and the genome becomes abnormal. Some forms of cancer can even be diagnosed by identifying individual chromosomal aberrations, notes Prof. Shamir, pointing to the example of a specific type of leukemia that is caused by small piece of chromosome 9 being moved to chromosome 22.

When analyzing many different kinds of cancer, however, the researchers discovered that chromosomal aberrations among different cancers happen together in a noticeable and significant way. The researchers studied a collection of more than fifty thousand cancer karyotypes ? representations of chromosomal layouts in a single cell ? and charted them according to commonalities. The researchers were not only able to confirm different chromosomal aberrations that appeared in specific cancer types, but also for the first time identified a broader effect of pairs of chromosomes being lost or gained together across different cancer types.

It was also the first time that researchers saw a connection among solid kidney, skeleton, and liver cancers. While it was known that these cancers all develop in the embryo, they were previously analyzed independently. The TAU researchers have now confirmed that they share chromosomal characteristics and aberrations, much like various forms of leukemia or lymphomas.

Aberrations a driving force for cancer

Under normal circumstances, even a small change to a person's chromosomal structure can be devastating. For example, Down's syndrome is caused by a single extra copy of Chromosome 21. "But in cancer, there are many cases of extra or missing chromosomes. Yet cancer cells thrive more effectively than other cells," Prof. Shamir says.

Prof. Shamir hopes that future investigation into these chromosomal aberrations will give researchers more clues into why something that is so detrimental to our healthy development is so beneficial to this disease. Cancer is the result of sequences of events, he says, each causing the genome to become more mutated, mixed, and duplicated. Tracking these changes could aid our understanding of the driving forces of cancer's progress.

Egypt army pardons 1,959 detainees, prominent activist (Reuters)

CAIRO (Reuters) ? Egypt's military ruler has pardoned 1,959 people convicted by military courts in the year since President Hosni Mubarak's ouster, including activist Michael Nabil whose hunger strike had brought him close to death.

The state Al Nil television channel said the convicts had been pardoned by Hussein Tantawi, head of the military council that has ruled Egypt since Mubarak's removal in February 2011 in the midst of the Arab Spring protests that swept the region.

The pardon comes just four days before the first anniversary of the 18-day Egyptian uprising which began on January 25, though it was not clear if any of the detainees had yet been released.

Nabil, jailed by a military court for defaming the army, had his prison term reduced to two years from three in December following criticism from international human rights groups.

The 25-year-old was arrested in March and began a hunger strike to protest against his conviction for posting remarks saying the army had tried to quell the uprising against Mubarak.

The generals now ruling Egypt say the army took no part in a police crackdown on protesters and have pledged to hand over to civilian rule by June.

Activists say Nabil's case highlights the Egyptian army's heavy-handed approach to dissenters who criticize its top generals for using tactics reminiscent of Mubarak's regime.

"We can only say the revolution has succeeded when they release all activists, besides Michael, who are still being held in military courts and retry all civilians who have been prosecuted by courts they shouldn't have been prosecuted by," Nabil's brother Mark told Reuters.

No To Military Trials, a pressure group set up after the uprising, says at least 12,000 cases have come before the military courts since February. The group says sentences are often handed out swiftly behind closed doors and without proper legal representation.

It is not clear exactly how many activists and protesters convicted by military courts in the past year remain in jail.

The pardon comes as youth groups plan to hold major demonstrations to mark the anniversary of a revolt they say will not be complete until the generals hand power to civilians.

"The family has only received word of the decree but Michael is still in custody and they are waiting to hear of his movements," Mark Nabil said.

"The revolution must continue as long as any civilian is still being held unjustly in a military prison."

Afghan president sends condolences to France

KABUL, Afghanistan (AP) ? Afghan President Hamid Karzai offered his condolences to France's defense minister on Sunday, following the killing of four French troops by an Afghan soldier.

The shooting Friday in eastern Afghanistan provoked a sharp reaction from Paris, prompting President Nicolas Sarkozy to suspend training missions and threaten to withdraw French troops early from the country.

On Sunday, Karzai met with French Defense Minister Gerard Longuet in Kabul and discussed the killings and Afghan-French relations.

Karzai's office said Longuet still sounded prepared to sign a long-term partnership to keep French forces in Afghanistan for years. The Afghan government expects the deal to be signed next week, said Foreign Ministry spokesman Janan Mosazai.

The shooting last week was the second in which an Afghan soldier has turned on French forces since France first sent forces here, and the latest in a rising number of assaults in which Afghan security forces or infiltrators have turned their guns on coalition troops.

Before the meeting with Karzai, Longuet said his mission in Kabul was to "evaluate the attitude our officials should take" in the future.

Karzai's office said the Afghan government is investigating the shooting.

"France is an old and sincere historic friend of the Afghan nation and has remained as such," Karzai told Longuet, according to the statement, in an apparent move to smooth out relations.

French Foreign Minister Alain Juppe spoke by phone Saturday night with U.S. Secretary of State Hillary Rodham Clinton about the French troops' deaths and Paris' intentions in Afghanistan.

The French Foreign Ministry said in a statement that Longuet will give Sarkozy a report on his visit to Kabul. The president will then "draw all the conclusions from the attack," the ministry said, in a reference to whether Paris will maintain its mission in the coalition.

Karzai is to visit Paris on Jan. 27, a trip scheduled before the killings.

Longuet's trip coincides with a visit by the U.S. envoy to Afghanistan and Pakistan, Marc Grossman, who began meeting with Karzai and Afghan officials on Saturday. The U.S. is trying to negotiate its own long-term partnership agreement, along with supporting plans to bring the Taliban insurgency into formal talks for the first time.

Lombardo on Legal Archaeology

Paul A. Lombardo published an essay "Legal Archaeology: Recovering the Stories behind the Cases" in the Fall 2008 issue of the Journal of Law, Medicine, and Ethics. ?It reminded me of the wonderful chapters in this volume of "health law stories." ?Here are some excerpts that may be of interest:?

?Every lawsuit is a potential drama: a story of conflict, often with victims and villains, leading to justice done or denied. Yet a great deal, if not all, that we learn about the most noteworthy of lawsuits ? the truly great cases ? comes from reading the opinion of an appellate court, written by a judge who never saw the parties of the case, who worked at a time and a place far removed from the events that gave rise to litigation.

Rarely do we admit that the official factual account contained in an appellate opinion may have only the most tenuous relationship to the events that actually led the parties to court. The complex stories ? turning on small facts, seemingly trivial circumstances, and inter-contingent events ? fade away as the ?case? takes on a life of its own as it leaves the court of appeals.

How can a law professor correct this bias? ?Here are some of Lombardo's suggestions:?

The best starting point for doing legal archaeology is the case record itself. We all begin our investigation of cases by reading an appellate opinion. With some extra effort, we can retrieve the records and briefs that the judges relied on as they wrote that opinion. Of course, the case record that is printed for submission to an appellate tribunal will include only a small portion of the documents that make up the lawsuit?s paper trail.

Much of the material contained in the case record is now filed electronically, and for recent cases, may be available on the Web. But even for most pre-Internet cases, finding the proper repository for all these records is not difficult. A visit to your school?s reference librarian with copies of the articles referenced here should get you started.

Lombardo also suggests consulting newspapers and magazines, professional journals, and material generated by the parties and their lawyers. ?Though some students may complain of "reading overload," skillful editing can make the effort to contextualize the cases well worth everyone's while. ?I also anticipate that internet archives of particular helpful case studies will accumulate over time.

Novartis drug investigated after 11 deaths (AP)

LONDON ? A European agency is investigating a multiple sclerosis drug made by industry giant Novartis to determine whether the medicine played any role in the deaths at least 11 patients.

The drug, Gilenya, was licensed last year in the European Union to treat a severe type of multiple sclerosis. It can cause a slow heart rate when first taken and doctors closely monitor patients after the first dose.

The European Medicines Agency, which is now investigating the drug, said it isn't clear if it caused the deaths. One of the fatalities occurred in the United States, where a patient died within 24 hours of taking the first dose.

The European agency said it didn't know where the other 10 deaths occurred, but that they were reported to its drug database, which monitors side effects from medicines in the European Union.

Novartis said not all the deaths were heart related.

A spokeswoman at the U.S. Food and Drug Administration said it also is conducting a data analysis but has not made any definitive conclusions and does not know when its review will be complete.

More than 30,000 patients have taken Gilenya worldwide.

The European Medicines Agency advised doctors to increase their monitoring of patients after the first dose of the medicine. The agency said the risk of a slow heart rate after the first dose of Gilenya was known when it was approved.

Novartis AG said it was advising doctors of new recommendations on using Gilenya. They had previously said all patients should be monitored for six hours after their first dose, but are now tightening that to include continuous heart monitoring using electrocardiograms and measuring blood pressure and heart rate every hour. In certain patients, that monitoring should be extended, the drug maker said in a statement.

This new guidance applies only to patients taking their first dose, Novartis said in a statement.

The EU drug regulator hopes to finish its review of the drug by March.

Feds grant 1-year extension on birth control rule

(AP) ? In an election-year decision certain to disappoint religious conservatives, the Obama administration announced Friday that church-affiliated institutions will get only one additional year to meet a new rule to cover birth control free of charge.

Friday's announcement by Health and Human Services Secretary Kathleen Sebelius does not apply to houses of worship. Churches, synagogues, mosques and other places of worship were already exempt from the birth control coverage rule.

But in many cases, other religious-affiliated employers such as hospitals and universities traditionally have not provided any birth control coverage for their employees. They were seeking a broader exemption that would allow them to continue that practice.

The new rule is part of a package of improved preventive services for women under President Barack Obama's health care overhaul. Birth control is on a list of services that most workplace health plans will have to cover free of charge to employees.

Instead, the one-year extension applies to nonprofit institutions such as church-affiliated hospitals, universities and social service organizations. They will now have until August 1, 2013, to comply. Because of the way health insurance plans work, their employees will not have access to the new coverage until January 1, 2014, in most cases.

Birth control use is virtually universal in the United States, and most employer health plans already cover it, usually with copays for employees. Last year, an advisory panel from the prestigious Institute of Medicine recommended that the government require birth control coverage as preventive care under Obama's law, meaning it would become available free of charge.

Sebelius quickly agreed, issuing a new federal regulation.

But religious groups complained that a conscience exemption included in that rule was too narrowly written. Catholic hospitals, which defied the bishops to support passage of Obama's health care law in Congress, were among those who objected.

Sebelius said her decision Friday was carefully considered.

"I believe this proposal strikes the appropriate balance between respecting religious freedom and increasing access to important preventive services," Sebelius said in a statement.

Nonetheless, conservatives in Congress are already pursuing legislation to try to block the regulation. And Republican presidential candidates say they would derail it also, by repealing the health care law if elected.

For most American women, the birth control coverage requirement will take effect sooner. Employer health plans in most cases have to comply by August of this year. Because of the time involved in adding new coverage, that means the majority of women will be able to receive free birth control coverage starting January 1, 2013.

Fujitsu hasn't been a major player in the mobile race on this side of the pond, but it looks like the company's working to change that -- better late than never, right? Last week we spent some time with its "world's thinnest smartphone," the F-07D, and now TechFokus claims to have gotten its hands on a Tegra 3-packing tablet from the Japanese manufacturer that's supposedly set to launch in May. Aside from the aforementioned NVIDIA processor, the slate's also said to come equipped with an "HD" (1280 x 800) display, 16GB of onboard storage and the usual front and rear shooters, at 3 and 8 megapixels, respectively. The tablet, dubbed Stylistic m532, is expected to carry a €499 (around $630) price tag, and although it is currently rocking Honeycomb, it's expected to hit the masses adorned with Ice Cream Sandwich. By the looks of it, there's nothing to write home about here, but you can be the judge by checking out the video after the break.
